As the professional body for solicitors, every week the Law Society is working hard to influence the legal and regulatory environment on behalf of our profession and to promote solicitors at home and abroad. We support practice excellence, are an informed source of legal sector news and support members at every stage of their career.
 
The Law Society’s media profile this week: 

Government plans to accelerate proposed judicial review (JR) reform after the prime minister claimed JR was being used to “conduct politics by another means” were covered in Friday's print edition of the Times (£). I am quoted: “Any proposals to change this system must be developed through consultation and subject to full scrutiny to ensure that ordinary people do not lose out because of a rush to reform.” Also in the Independent and Daily Mail.
 
HM Courts and Tribunals Service (HMCTS) announced plans to allow broadcasting of sentencing remarks in some crown court trials. The Law Society has welcomed the move in the Guardian, Telegraph and Gazette. There is also an explainer on BBC News.
 
I said: “Done sensitively, and with the appropriate reporting restrictions, broadcasting from the courts during some proceedings – such as sentencing – could add significant value and assist in the rule of law being respected.”
 
The Gazette examined the two commissions promised in the Queen’s speech - into criminal justice and the Supreme Court – and cites our concerns about the state of the criminal justice system. I said: “We all want swift, fair and effective justice, but it cannot be delivered on the cheap.”

The Times (£) reported English courts are being used to launder money from Russia. I said: “Solicitors are highly regulated and - in line with their obligations - are all too aware of the dangers posed by international criminal gangs.”

The Gazette reported the announcement of new QCs. I said: “My warmest congratulations to all those solicitors taking silk. My predecessor as president, Rodger Pannone, helped to secure higher rights of audience for solicitors. Glyn Maddocks is a respected member of our human rights committee known for his wide-ranging pro bono work. Their honorary appointments are thoroughly deserved.”
 
Tim O’Sullivan, chair of our EU committee, wrote an opinion piece for the Gazette on the timeline for Brexit trade negotiations. He said prioritising legal services will not “not only benefit the UK economy but it will help clients in the EU who currently benefit from being able to choose law firms from this jurisdiction”.
 
The Gazette also covered the Law Society’s response to the Mayson Review. The article refers to our concern that: “Unintended consequences could well be many small firms leaving the market, the legal sector contracting, and the cost of legal services increasing, leading to further unmet demand.” Also in Legal Futures.
 
Today’s Wills and Probate has our welcome of the lord chancellor’s decision to raise the statutory legacy sum so, from 6 February 2020, spouses or civil partners with children will be able to inherit £270,000 from intestate estates rather than £250,000.
 
The Gazette reported on the simplification of the Immigration Rules under the 1971 Act, following a consultation response by the Law Society. Barry O’Leary, a member of our immigration law committee, said: “We welcome how far they think we should go in terms of redrafting, and acknowledging that the rules need to be suitable for the non-expert user, accurate, clear and consistent.”
 
Legal Futures and Inside Conveyancing cites our recent practice note on flood risk in its analysis of the effect of excessive flooding on travel, the environment, properties, businesses and infrastructure.

The Gazette covers life as a freelance solicitor and cites our top tips for those considering going solo.

The Gazette investigates succession planning for businesses. John Scott, a member of our small firms division, said “when it comes to proper preparation for retirement you cannot really start young enough”.

Justice

On Friday 17 January, along with Vice President David Greene and CEO Paul Tennant, I attended a meeting with the new chair of the Bar Council, Amanda Pinto QC, to discuss how the Bar and the Law Society can best work together in the year ahead.

Law Society meeting with Italian Senators
Our policy and international teams met with a small group of Italian senators to discuss reforms to the family courts, particularly the changes already enacted and ongoing in the family court modernisation programme. 
We explained that digitisation of existing processes is an overdue reform and a lot of it is generally working quite well, with members agreeing it is helping with improved case management. However, we highlighted areas to be aware of including the impact of court closures; digital exclusion and the importance of people having access to legal advice; video hearings; and the importance of robust analysis and evaluation of data when undertaking a modernisation programme on this scale.
  
Court broadcasting
Judges’ remarks are to be broadcast from Crown Courts under draft legislation to be laid by government. The Crown Court (Recording and Broadcasting) Order 2020 will permit the sentencing remarks of High Court and senior circuit judges in certain criminal cases to be filmed and broadcast to the public. No other court users – including victims, witnesses, jurors and court staff – will appear on camera. (See Media above).

Regulation

5th Money Laundering Directive – summary of changes 
On Friday 10 January, the EU’s 5th Money Laundering Directive came into force. The Legal Sector Affinity Group, which includes the Law Society and all the legal sector supervisors named in the anti-money laundering regulations, has published a summary of changes to the regulations to help firms comply with the new requirements which can be found here. 
 
Commercial and Technology Law

AI and Law research
We held a joint session with Oxford University where they presented the emerging findings of their AI and law research. Oxford is developing a research agenda that uses machine learning to classify, track and horizon scan skill requirements in the UK legal services sector based on a big data feed.

Brexit
The Brexit law committee met with the lord chancellor and the parliamentary under secretary of state, Chris Philp MP, to discuss the next phase of the UK’s withdrawal from the EU, legal services and civil judicial cooperation.
 
Speeches

Our vice president David Greene gave welcoming remarks at the opening of the Law Society Art Group’s 60th Anniversary on Friday 16 January.

Our work internationally:

On Wednesday 15 January Helena Raulus, head of the Brussels office, presented the FCO masterclass on civil and commercial judicial co-operation post-Brexit with David Greene organised by Foreign & Commonwealth Office.

On Friday 17 January Helena Raulus will chair the British Chamber of Commerce lunch event on: “Ensuring gender balance, inclusiveness and diversity”.

Event: ICAEW East Anglia - Grand Debate (Cambridge Union, 18 March 17:30-20:30)
 
The Institute of Chartered Accountants in England and Wales (ICAEW) are holding an event which will debate the motion of 'this house believes that a vibrant East Anglia needs full economic devolution'. As this is a contentious topic, the proceedings will be chaired by Lord Norman Lamont, former Chancellor of the Exchequer, who will host the debate and act as speaker of the house.

5th Money Laundering Directive - summary of changes

Handling complaints practice note updated
 
The SRA Standards and Regulations 2019 replaced the SRA Handbook (2011) from 25 November 2019. Our updated practice note is relevant to all law firms and sole practitioners authorised by the SRA. It is also relevant to individual solicitors, RELs and RFLs, wherever they practise.

SRA Corporate Strategy 2020-2023 consultation -  closing date for responses 23 January 2020 - Link to consultation
 
The SRA is seeking views on its new Corporate Strategy which sets out SRA priorities for the period from 2020 to 2023. The three key areas cited are:
  • “Embedding high standards for ourselves and the profession: implementing, evaluating and evolving our reforms and regulatory model.
  • Technology and innovation: supporting the development and adoption of technology and other innovation so that opportunities and new ideas can flourish.
  • Anticipating and responding to change: building our understanding of emerging opportunities and challenges so we can effectively respond to them.”

Influencing on behalf of the profession and promoting the profession

The Law Society’s media profile: 

On 27 December I was interviewed by Radio 4’s Today programme for a special edition guest-edited by retiring Supreme Court president, Baroness Hale. I spoke about the need to improve access to justice following cuts to legal aid, claiming that “we have a system of justice which is in shocking disrepair”.
 
I also referred to the erosion of trust in the professions and the rule of law. The comments were aired throughout the day on BBC Radio 2 and BBC regional stations. The full interview is available here. (1:14:24 to 1:17:24). Lady Hale voiced concerns about the impact of legal aid cuts for civil cases, highlighting the particular impact on the family courts. She said that many disputes are reaching court which could be settled if legal aid for early advice were available.

Richard Miller, head of justice for the Law Society, argued the cuts represented a ‘false economy’ in an interview for BBC News at Six – comment aired on News at Ten and BBC regional radio: "What we are seeing, as a result of the cuts, is cases that could be resolved - or that should never have been brought - coming into the courts… the savings to be made from this investment are so clear-cut, the case should be overwhelming for early advice to be restored.”
I. Stephanie Boyce, deputy vice-president of the Law Society, was featured in the Sunday Times Style series #StyleLeadingWomen – in which leading women answer career-related questions. 
 
This is Money looked at the rights and financial benefits now available to opposite-sex partners in civil partnerships. Denise Lester, a member of council, says: “Civil partnerships formalise relationships in law. This means you will get certain financial and property protections both during and after death or dissolution.”

Law Society access to justice committee member Jenny Beck spoke to TalkRadio (1200-1230 segment, from 04:50) on what is known as ‘divorce day’ about the importance of legal aid being restored for early legal advice in family law.

The Gazette reported police station detainees had to wait hours to see a duty solicitor on New Years Day after the collapse of the Defence Solicitor Call Centre (DSCC) system.

There was wide coverage of the Law Society's Junior Lawyers Division (JLD) of their campaign to promote responsible drinking cultures in law firms, in the Gazette, Telegraph (£), Legal Futures, Legal Geek , the Daily Star,  Sun, Times (£), Independent, Law Careers and on seven local BBC radio stations. The JLD’s blog in the Lawyer also covers the campaign and their resolutions for 2020.

York Press carried a letter picking up on an article by Stephanie Boyce to mark the centenary of the Sex Disqualification (Removal) Act of 1919.
 
Local Government Lawyer reported our response to the government’s proposed changes to the housing possession court duty scheme and cites our concerns over legal aid contracts.

Yorkshire Business reported Leeds Law Society will be holding a women in law event to mark the centenary of the Sex Disqualification (Removal) Act. Former Law Society president Christina Blacklaws said: “Gender equality is not just an issue for half of us, but all of us.”
 
The Gazette cited our response to the Ministry of Justice consultation on changes to the Housing Possession Court Duty Scheme. The Law Society warned that some legal practices are earning as little as £37.50 an hour under the scheme.

Legal Futures looked at new research into law firm ‘onshoring’ – citing Law Society data on the gender split between offices.

Family
The renewed Divorce, Dissolution and Separation Bill had its first reading in the House of Lords on Tuesday 7 January. The previous version of this Bill had already got to this stage prior to the dissolution of Parliament for the general election last year. The Law Society has produced a parliamentary briefing which we will circulate to members of the House of Lords once the date for the Second Reading has been announced.

Immigration
The Immigration Law Committee submitted a response to the independent chief inspector of Borders and Immigration’s call for evidence on the work of presenting officers. The response included experiences of Law Society members working with presenting officers and common problems found in practice that could be addressed.

Parliamentary

We briefed MPs ahead of the European Union (Withdrawal Agreement) Bill’s committee stage, which ran from Tuesday 7 to Thursday 9 January. During the debate, the Law Society’s arguments on lower courts and the role of Parliament were cited by former Justice Select Committee Chair, Sir Bob Neill MP (Conservative), SNP justice and home affairs spokesperson, Joanna Cherry QC MP, and shadow Brexit minister, Thangam Debbonaire MP, with Neill also suggesting the Brexit law committee be consulted by government on proposed changes to the powers of the judiciary. The Law Society was mentioned during the debate on the Queen’s Speech (home affairs, justice, constitutional affairs and devolved affairs) in the House of Lords. Lord Beecham stated: “The Law Society calls on the government to ensure adequate funding across the whole criminal justice system, not just a few parts of it.”

Our work internationally:
 
I visited Singapore from Sunday 5 to Tuesday 7 January to attend the opening of the legal year (OLY). As part of the OLY programme, we met with members of the Law Society of Singapore ExCo, attended the ceremonial opening of the legal year, and participated in a discussion with other international bar leaders at a presidents’ roundtable hosted by the Law Society of Singapore. At the roundtable, I co-facilitated a discussion on "future readying the legal profession" with colleagues from the Malaysian Bar Council, Guangdong lawyer’s association and Daini Tokyo bar association. 
Both the roundtable and the speeches given at the OLY discussed a number of common issues across our jurisdictions and legal professions. This highlights the importance of our continued cooperation and open dialogue on such matters.
 
During our visit, we held a roundtable with member firms where we discussed developments in the legal services market and how the Law Society can best provide support. Also in attendance was the British high commissioner, Kara Owen, and first secretary and deputy-director, Justinian Habner. We then met with the High Commissioner separately afterwards to identify areas of collaboration. I met with the deputy trade commissioner for South East Asia to discuss our regional strategy. 
To further our strong collaboration with the region, I also met with the Ministry of Law and the president of the Law Society of Singapore where we discussed a number of developments including lawtech in both England & Wales and Singapore. I look forward to continuing these discussions and working together throughout the year.
